Common Core Testing Regime Ruled Unconstitutional

In a development with massive implications for the Obama administration’s ongoing attempt at nationalizing education with Common Core, a Missouri judge ruled this week that the federally funded testing regime for the controversial standards was unconstitutional. The ruling means that the state of Missouri is officially prohibited from participating in the “Smarter Balanced Assessment Consortium” (SBAC), a key element of Common Core enforcement, because it’s an “unconstitutional interstate compact.”

The lawsuit against participation in the scheme was filed late last year by a group of taxpayers seeking to uphold the rule of law, safeguard public funds, and stop Common Core. Judge Daniel R. Green, with the Circuit Court of Cole County, Missouri, ruled in favor of the plaintiffs and ordered the state to immediately halt all involvement with the federally funded “multi-state” testing regime. In particular, Judge Green noted that Congress had never approved the interstate compact being foisted on states by the Obama administration’s Department of Education.

“The Court finds that the Smarter Balanced Assessment Consortium, a.k.a. Smarter Balanced, Smarter Balanced at UCLA, SBAC, and SB, is an unlawful interstate compact to which the U.S. Congress has never consented, whose existence and operation violate the Compact Clause of the U.S. Constitution, Article I, § 10, cl. 3, as well as numerous federal statutes,” the judge ruled. “Missouri’s participation in the Smarter Balanced Assessment Consortium as a member is unlawful under state and federal law.”

As such, the court declared that “any putative obligations, including the obligation to pay membership fees, of the State of Missouri to the Smarter Balanced Assessment Consortium … are illegal and void.” The judge also declared that “no Missouri taxpayer funds may be disbursed to SBAC in the form of membership fees, whether directly or indirectly.” Finally, the court permanently prohibited state officials, and “all those in active concert with them,” from “taking any action to implement or otherwise effectuate any payment of Missouri funds as membership fees to SBAC, whether directly or indirectly.”

Commie watch – The Tea Party is Getting Worse: Media May Want a New Narrative, but GOP is Still Nuts

It’s not over in the U.S. Congress, where a shutdown-in-miniature is unfolding between the White House and the Tea Party wing of the GOP. It’s not over in Wisconsin, where a Tea Party-darling governor is slashing the state university system’s funding, changing its mission statement (while lying about it), and fighting tooth and nail to humiliate people on government benefits. It’s not over in North Carolina, where a billionaire-backed Tea Party government is also going after the public university system in its effort to turn the state into Kansas. And it’s not over in South Carolina, where one state representative hopes to mainline National Rifle Association propaganda to a generation of public school students.

Let’s stick with the South Carolina example for a moment, because I think it tells us much about the contemporary GOP’s character. According to Kimberly Johnson of Al Jazeera America, the recent decision on the part of PTR Industries, a gun manufacturer, to move its headquarters from Connecticut to South Carolina has inspired Republican state Rep. Alan Clemmons to propose what he’s calling the “Second Amendment Education Act.” As the name implies, the bill would “provide all public elementary schools, middle schools, and high schools” with “instruction in the Second Amendment” for no fewer than “three consecutive weeks in one grading period in each academic year.” The curriculum would be written by the NRA, of course.

FK – I knew what the snake flag stood for before the ‘tea party’ was cool. I knew we needed “Liberal”(commie) trash season years ago.

‘Hobbit ring’ school suspension merits closer look

“A Kermit [Texas] parent said his fourth-grade student was suspended Friday for allegedly making a terroristic threat,” the Odessa American reported Friday. After seeing “The Hobbit: The Battle of the Five Armies,” nine-year-old Aiden Steward allegedly brought a ring to school and told a classmate it was magic and could make him disappear.

The boy’s father, Jason Steward, said Kermit Elementary School Principal Roxanne Greer informed him “threats to another child’s safety would not be tolerated — whether magical or not.” For her part, Greer declined to comment, citing confidentiality requirements.

What’s unknown is how much of the story as reported comports with the totality of events and what was actually said and done. If all is as related in the OA Online report, it recalls other hysterical overreactions on the part of teachers and school administrators, such as the account of a child suspended for biting a strawberry tart into something supposed adults said looked like a gun, or the teen confronted by officials and police for fantasizing about shooting a neighbor’s pet dinosaur, or my personal favorite, a county-wide school lockdown and detention of a student after a worker misinterpreted the lyrics to “Fresh Prince of Bel-Air” that accompanied a voicemail.

In fairness to the staff and teachers in Kermit, the news account only presents one subjective side to the story, privacy policies do preclude publicly sharing disciplinary actions, and the child in question did reportedly have previous infractions, although the release of that information, from which some no doubt will want to draw conclusions, should also be questioned. Whether the ring business was a gross overreaction or a final straw remains to be disclosed.

FK – My short experience with the amerikan indoctrination system taught me that not only is it full of commies and ignorant dupes but that jerks often raise jerks.

The kid could have been a true problem child and of course the parents will defend it’s actions if they don’t know any better, or don’t care, or are looking for money.

Getting the commies out of the schools will be the first order of business after the war crimes trials are completed.

Where is the NRA? Have you asked them what they’re response to the ultimate action is, the passage of such a law and the murder and imprisonment of those who do what they should: refuse to comply?

Until enough come to grips with the necessity of doing what will be required we will constantly be fighting this war.
